Opponents have shelved court challenges against Brisbane City Council’s approval of a 28-storey office tower in Fortitude Valley, after gaining concessions from the developer.
The agreement paves the way for work to begin on the tapered building, which would be one of the Valley’s tallest towers.Credit:PJP Properties, owners of the adjacent former McWhirters bulk store at 47 Warner Street, appealed the council’s May 2022 approval, but withdrew that appeal in October after reaching an agreement with the tower’s developer, Pidson Investments.
Both parties went into mediation, which resulted in a volumetric easement for the Warner Street property, which featured on the council’s heritage register. A minor change to the project’s development application to reflect that agreement was lodged with the council in the past week. “In resolving [the] appeal, the applicant agreed to make a minor change application to ... facilitate the granting of an easement for future access purposes to the adjoining property,” town planning firm Urbis said in its assessment report.“... No other changes to the approved development are proposed, including no changes to the approved drawings and documents.”
A separate appeal from the body corporate for the adjacent office building at 269 Wickham Street was also discontinued in October.
