A Department of Justice report details Special Counsel Jack Smith's decision to indict President-elect Donald Trump on four counts related to obstructing the 2020 election vote count. The report concludes that the evidence would have been sufficient for a conviction but Trump's impending presidency on January 20th makes prosecution impossible. Trump denies the charges, calling the investigation politically motivated.
President-elect Donald Trump engaged in an unprecedented criminal effort to overturn his 2020 election defeat, according to a report released by the Department of Justice.
The report details Mr Smith's decision to bring a four-count indictment against Trump, accusing him of plotting to obstruct the collection and certification of votes following his 2020 defeat by Democratic President Joe Biden. "But for Mr. Trump's election and imminent return to the Presidency, the Office assessed that the admissible evidence was sufficient to obtain and sustain a conviction at trial."Trump was quick to respond to the report's release, calling Mr Smith "deranged" and a "lamebrain prosecutor who was unable to get his case tried before the election".
"The claim from Mr. Trump that my decisions as a prosecutor were influenced or directed by the Biden administration or other political actors is, in a word, laughable," he wrote.Mr Smith — who left the DOJ last week — dropped both cases against Trump after he won last year's election.Mr Smith's case faced legal hurdles even before Trump's election win, however.
The DOJ has committed not to make that portion public while legal proceedings continue against two Trump associates charged in the case.Photo shows US Special Counsel Jack Smith looks down, holding a brown leather file as he stands at a podium in a business suit.
