Federal Environment Minister Sussan Ley has rejected an application from First Nations leaders to stop a NSW South Coast mine expansion after the discovery of a large number of Indigenous artefacts.

In September, the Illawarra Local Aboriginal Land Council lodged an application under section nine of the Aboriginal and Torres Strait Islander Heritage Protection Act to asses the impact to Aboriginal cultural heritage.Federal Environment Minister Sussan Ley rejected the request claiming there was insufficient evidence to protect the area under the act.
They noted there were three archaeological artefact sites within the expansion footprint, that the likely location of the 1818 Minnamurra River massacre was near the site and there is a high probability of Indigenous graves. "It is completely disappointing that the Minister has taken this position," said the council's chief executive Paul Knight.
