David McBride has been in jail since May this year when he was given a nearly six-year sentence for sharing secret military documents with journalists.

Former military lawyer David McBride has fronted the ACT Supreme Court today, from jail, where he was granted leave to appeal against his convictions and sentence, despite lodging the application well after the deadline.McBride has been in jail since May when he was sentenced to nearly six years jail for sharing secret military documents with journalists.

He pleaded guilty to three charges including theft, after the court refused to allow his key defences in a trial. McBride's case was that he did not believe he was breaking the law, because he had a duty to reveal the material.ACT Supreme Court Registrar Jane Reece told the court the Commonwealth Director of Public Prosecutions had decided not to oppose the application to appeal out of time.

She told McBride she brought him to court to tell him herself that he would be allowed to launch his appeal, rather than send him a letter.Armed ConflictUnrest, Conflict and WarPhoto shows Sheila Raymond and family membersPhoto shows David speaks into a microphone as supporters' signs wave behind him and a guy holds a guitar.Photo shows A composite image of two men, whose faces are slightly in shadow.
