Tennis star Novak Djokovic could be "detained" again if he wins an appeal against his last-minute visa cancellation, the federal government's lawyers argue, denying it told the world number one his "so-called 'medical exemption'" would be accepted.
His letter from Tennis Australia did not "give any medical reason why the applicant could not be vaccinated".Novak Djokovic has been confined to an immigration detention hotel as the No. 1 men's tennis player in the world awaited a court ruling on whether he can compete in the Australian Open later this month.
Nor would the quashing of the cancellation guarantee the nine-time Australian Open the chance to defend his 2021 title, the government argued, saying the Minister could then decide whether to make "another cancellation decision"."From the time those orders are made, the respondent will act on the basis that the applicant's visa has not been cancelled."
Given the email, "a visa unqualified by any relevant condition" and the "exemption" from AO organisers, Djokovic "understood that he was entitled to enter Australia and Victoria and to compete in the Australian Tennis Open".But the minister's lawyers said the department email did not state Djokovic's "so-called 'medical exemption'" would be accepted.
