Newly appointed Minister for Home Affairs and Immigration Tony Burke has announced the federal government's intention to attain as many preventative detention orders as it possibly can to 'lock up' freed NZYQ detainees.

He takes over from Mr Giles who had the ministership when the 2023 NZYQ High Court decision was passed that allowed 154 former detainees to be released into the public on the basis that indefinite detention was illegal for those who had no real prospect of deportation from Australia.Immigration Minister Tony Burke has revealed the federal government is looking to lock up freed NZYQ detainees.

“Do you have an intention of pursuing preventative detention orders? How many and when?" Clennell asked. "Once the high court made the decision that it made, the threshold became high to successfully launch a case. I asked about it in my first briefings because I’m really concerned about it.
