Jubelin argued five grounds of appeal, including that a warrant was in place when the first three recordings were made, which meant they were authorised, and that Magistrate Ross Hudson erred in failing to give himself two directions. Judge Townsden said he does not accept on the balance of probabilities that Jubelin made the recordings to protect his lawful interest, as Jubelin had maintained throughout the court case.

While a warrant was in place for some of the recordings, Jubelin did not fill out a form listing his phone as one of the recording devices used.
