Kathleen Folbigg pardoned and freed from prison
Twenty years after she was convicted over the deaths of her four young children, Kathleen Folbigg has been pardoned and freed from prison after a landmark inquiry concluded there is reasonable doubt about her guilt.
Folbigg was pardoned and released from Clarence Correctional Centre in Grafton, also on Monday morning.Daley said he took steps to ensure Folbigg found out about the pardon “in advance of anyone else”, including the media, “to ensure that there was appropriate support around her when she was told”. As attorney-general he had the power independent of the inquiry to recommend the governor grant Folbigg either a pardon, paving the way for her unconditional release from prison, or grant her conditional release on parole.Daley said he received a call from Bathurst on Tuesday last week. The former chief justice indicated he had made “substantial progress” in drafting his final report and had come to a firm view about the conclusions he would make.
Bathurst’s decision marks the Folbigg case as one of the biggest miscarriages of justice in Australian legal history. This is the second inquiry into Folbigg’s convictions. A first inquiry, headed by former NSW District Court chief judge
