Thirty-eight of Victoria's most eminent legal practitioners have signed a letter condemning the comments of Daniel Andrews and calling for a public apology following the closure of the special investigative office set up to probe the Lawyer X scandal.
Barristers have signed a letter calling for Daniel Andrews to retract his comments and publicly apologise to Geoffrey Nettle
"Investigators don't make good prosecutors, there needs to be a separation. If you have investigated a matter, you are altogether too close to it to be making decisions about whether a conviction is likely. The only thing — the only thing — that should guide that is the considered judgement of the director of public prosecutions, director Judd," Mr Andrews said at a press conference on June 28.Daniel Andrews made comments about the investigation in June.
The closure of the Office of Special Investigator without any prosecutions means police and others involved in using criminal barrister Nicola Gobbo as an informant are unlikely to face criminal charges.Spokesman for the group barrister Darryl Burnett said Victorians deserved answers about the Lawyer X saga.
But, after 18 months and 5,000 pages of evidence, Mr Nettle's recommendations for prosecution were rejected by the Office of Public Prosecutions.between him and the DPP tabled in the Victorian parliament on June 21.The closure of the OSI has also raised concerns with retired judge Murray Kellam, who presided over the first inquiry into police handling of Ms Gobbo as an informant.
