A New Jersey couple who suffered serious injuries in an accident while using Uber is being prevented from suing the company. The couple, Georgia and John McGinty, argues that their daughter may have accidentally agreed to Uber's terms of service during a separate food order incident. However, the court ruled that Georgia McGinty was still liable for the agreement due to her prior consent to similar terms.

A New Jersey appeals court cites the Mercer County couple, both in their 50s, cannot sue because they agreed to Uber’s terms of service which feature an arbitration provision"waiving the right to a trial by jury" in the case of an accident. New Jersey Superior Court says that Georgia McGinty was still liable to the terms because she had agreed to prior versions of them.
