Jarryd Hayne walked out of prison yesterday after his sexual assault convictions were quashed on appeal. The Director of Public Prosecutions will decide whether he will be tried for a fourth time.
Jarryd Hayne has been released from prison on bail after his sexual assault conviction was quashed.As top prosecutors in NSW weigh up whether to run a fourth trial over sexual assault allegations against Jarryd Hayne , one of the appeal judges has suggested this would not be in the interests of justice.
But two of the three appeal judges upheld the other two grounds, which centred on how the trial judge dealt with a series of messages the complainant sent a friend on social media. Justice Stephen Rothman, who also upheld the second and third grounds of appeal — but dismissed the first — noted Mr Hayne's non-parole period is due to expire in May next year.
Mr Whealy added: "After all, one of the judges found that the verdict was unreasonable. The other two judges felt that very important evidence had been excluded." The woman alleged Mr Hayne tried to kiss her before proceeding with oral and digital penetration despite her saying "no" and "stop", with the activity ceasing when her genitals started to bleed.
Mr Hayne's lawyers told the appeals court the trial judge made a legal error by not allowing further evidence and cross-examination of the complainant regarding these communications, and others with a different man. The court was satisfied that a direction the trial judge gave to jurors, linked to her communications and the alleged lies she had told about whether they were concealed, had "exacerbated" the first error.
