The NYS Court of Appeals held a hearing regarding the disciplinary powers of the Rochester Police Accountability Board.
Wednesday, the NYS Court of Appeals heard arguments about the board's power to conduct disciplinary hearings. The Rochester Police Locust Club, the union representing RPD officers, sued the PAB, claiming it was an unlawful exercise of power. In 2020, Judge John Ark ruled that those disciplinary powers conflicted with New York State law."We know that the state of New York has blessed the moving of authority over disciplinary for policing to civilians. It happens regularly," said attorney Andrew Celli, who is representing Rochester City Council.
