The Barry Rose Reclamation Facility is the site of two incidents in recent months where waste water flowed into adjacent Clear Creek.Pearland is working to reach a settlement with the Texas Commission on Environmental Quality after city wastewater employees for years repeatedly violated state regulations, including telling a contractor to dump 150 gallons of bleach into Clear Creek — possibly leading to an otherwise inexplicable fish kill — and not reporting issues as required by law.

“This is a serious issue,” Councilman Alex Kamkar said. “The reality is that the TCEQ order says we did something wrong, and we need to do better. And if you read the report we did internally, it sure looks like negligence. Thankfully, no one has been hurt.” After the state’s visit to the Longwood facility, Pearland inked a $49,000 contract with Austin law firm Lloyd Gosselink to investigate issues in the wastewater department and work with state commissioners on settling violations, according to emails provided to the Houston Chronicle.

Several wastewater employees resigned during the course of the twin investigations into violations, officials said. And in May 2022, Pearland leaders spent $49,000 to hire the Brazos River Authority to take over control of the city’s wastewater services for a four-month period.State administrators July 29 sent Pearland the enforcement letter, recommending an $83,375 administrative penalty for the violations, according to Cann.
