Seven West Media is seeking to terminate its $450 million cricket rights deal, alleging Cricket Australia has repeatedly breached quality and standards provisions of the contract.
Seven, which signed the deal with Cricket Australian in 2018, lodged proceedings against cricket’s governing body in the Federal Court on Thursday. It wants the court to allow it to cancel its deal, for which it pays $75 million cash and $7 million in free advertising a year. The agreement is meant to run through to 2024.
Seven’s proceedings seek a court declaration that Seven is entitled to terminate the agreement, and damages arising out of past breaches. The network secured a $5.3 million discount in its cricket rights fee in March 2021, far less than it had asked for, in recognition of changes to the schedule and squad availabilities due to COVID-19. Seven also received a $3 million discount for the cancellation of a test match against Afghanistan following the Taliban’s seizure of power in the country, with concerns raised over the status of women’s cricket in the country.
“Seven has pursued the informal dispute resolution procedure under the [media rights agreement] but the procedure failed to resolve the dispute,” Seven said in a statement.
