Ms Xuan A Tran and Mr Quang Manh Dong are the owners of Vietnamese restaurant Vina Yummy Kitchen in Sandy Bay. Documents filed with the court by the Fair Work Ombudsman allege the couple were recruited by Ms Hai Tran's sister, Xuan, when they were living in Vietnam. Mr Nguyen, on the other hand, allegedly worked close to 70 hours a week and on average made just under $9.50 an hour for his ordinary hours.
The FWO said in its documents that the amount sent to the ATO had offset the amount allegedly owed to Ms Hai Tran.Further to this, in February 2017, it is alleged Ms Xuan Tran told her sister she would need to pay back some of her wages in order to cover her superannuation and taxes.
