The young driver of a car that crashed while towing an unregistered horse float, injuring five people and killing four horses, is charged with driving offences — as several of those involved in the crash battle for compensation.
Over 50 horses that participated that night had Mr Yole listed as their trainer.The driver has been charged with two counts of causing grievous bodily harm to another person by negligent driving, three counts of failing to ensure passengers were wearing a seat belt, and driving without due care and attention.
The workers sought a review of MAIB's decision by the Tasmanian Civil and Administrative Review Tribunal. "Section 25 of the WRC Act states if in any employment a worker suffers an injury, his employer is, except as is otherwise provided by this Act, liable to pay compensation to the worker," the documents said.In the board's decision, it said Ms Wakefield told a social worker at the Launceston General Hospital that she fell asleep in the car shortly after it left Launceston and did not recall any details of the crash.
"At the harness racing at Elwick Racecourse on 29 January 2023 Ms Wakefield attended as a volunteer, and she was not paid by Ben Yole or Ben Yole Racing Pty Ltd," the email said.
