A jury has found Peter Jason Cafe not guilty of dangerous driving in relation to a triple-fatal Bruce Highway crash.

Peter Jason Cafe, 53, pleaded not guilty to the charge at the beginning of a District Court trial in Townsville. Throughout the trial, jurors heard that Mr Cafe believed he had a microsleep moments before the crash.
In his summary, Judge Anthony Rafter SC told jurors that in order to find Mr Cafe guilty the prosecution had to prove he was fatigued on the day of the crash, knew he was fatigued and failed to take adequate steps to manage his fatigue. During three days of evidence the jury watched hours of footage that had been recorded on board the bus.
An expert witness specialising in signs of fatigue told the trial that Mr Cafe's yawning, rubbing his eyes and shifting in his seat were all symptoms of fatigue. The Crown argued that those signs of fatigue, and footage of Mr Cafe shortening and skipping rest breaks throughout the morning was evidence he knew he was fatigued but failed to manage it.
Mr Cafe's lawyer Tom Hancock told the jury that there were no signs on the morning that his client was dangerously fatigued. He raised the bus had stopped for more than 70 minutes over 5.5 hours of travel on the journey from Rockhampton to Townsville. Federal GovernmentRoyal Commissions
