The man pleaded guilty in the ACT Magistrates Court to assaulting the boy during a neighbourhood dispute.
A Canberra construction worker has pleaded guilty to assault in the ACT Magistrates Court after slapping a 12-year-old boy during a neighbourhood dispute.
The 57-year-old man, who cannot be named for legal reasons, said he had been intending to help a neighbour who had complained the boy and his friends were causing a disturbance on their street.In response, the man slapped the boy across the face, causing him to bleed from inside his mouth. After the incident, which occurred on March 11 2024, the man contacted police to complain that he had been the victim of assault.
After investigating, police charged the man, who pleaded guilty in the ACT Magistrates Court to assault occasioning actual bodily harm.Magistrate Glenn Theakston said the facts of the case were "unusual" and not something he had seen in court before. The man's defence lawyer, Michael Kukulies-Smith, said his client accepted that he had over-reacted and "deeply regretted" his response in the heat of the moment.
Magistrate Theakston said restorative justice, which is voluntary, had the potential to do "quite surprising things" and that it was not uncommon for the parties' relationship to become better than it was prior to the incident.
