Grocery giant Coles will pay farmers $5.25 million after the competition watchdog claimed the company had failed to pass on to them its 10 cent per litre drought levy on fresh milk.
Just two weeks following the March 19 announcement of the 10 cent per litre drought levy, Coles cut its payment to Norco from 10 cents to 3.5 cents, the consumer watchdog alleged on Thursday morning. This was due to an unrelated 6.5 cents per litre price rise which came into effect on April 1.ACCC chair Rod Sims said the regulator had been "fully prepared" to take Coles to court over the action, which he called an "egregious breach" of consumer law.
"Court action would also have taken many months if not years, with no guarantee that any money would have been paid to farmers as a result."
