An independent investigation found no further action was required, but Mr O'Byrne remains on the backbenchIn a late night statement, former premiers Lara Giddings and Paul Lennon called for Mr O'Byrne to "do the honourable thing and resign from the Tasmanian Parliament".In June, a former junior union staffer of Mr O'Byrne's alleged he kissed her and sent texts more than a decade ago without her consent.
An independent investigation cleared Mr O'Byrne but the formers premiers want the party's complaints handling process to be reviewed.In their statement, Mr Lennon and Ms Giddings said consent should never be assumed and the party should review its complaints handling process."Improper advances on women must stop and consent better understood when it comes to relationships between two people.
The former premiers' intervention comes after an emergency parliamentary Labor Party meeting late yesterday.Multiple MPs wanted Mr O'Byrne to resign ahead of Tuesday's return to Parliament but the ABC understands that MPs did not formally vote on whether he should remain in the party.
