Next year’s election will not only decide who leads the nation, it will also decide who is the next chief justice of the High Court.

Justice Stephen Gageler will be the most senior member of the High Court when Chief Justice Susan Kiefel retires.That leaves an outsider, perhaps a senior judge of another court, as the most likely option. This was the preferred courseand Murray Gleeson before him in 1998. French had been on the Federal Court since 1993, while Gleeson had been chief justice of NSW since 1998, and a leading silk.

The chief justice of the Federal Court, James Allsop, will also leave the bench in April 2023. The drums won’t stop beating about Federal Circuit and Family Court Chief Justice Will Alstergren replacing Allsop – but, like Gageler, his odds will lengthen if Labor gets in.The immediate interest around senior judicial appointments is at the state level. Chief Justice Bathurst will leave on March 5 and the new chief will be sworn in on March 7.

In Queensland, the practice has been to choose a member of the Supreme Court. The Newman government appointed District Court judge Tim Carmody in 2014, butNames mentioned as contenders include Justice Peter Applegarth, who moonlights as head of the Queensland Law Reform Commission and helped secure passage of assisted dying legislation, and Justice Peter Davis.
