The Federal Court has heard there's a dispute over whether bankruptcy papers have been served on Bruce Lehrmann in lieu of costs he's been ordered to pay after his failed defamation case against Network Ten and journalist Lisa Wilkinson .
Mr Lehrmann is trying to appeal against a judgement that on the balance of probabilities he raped his colleague Brittany Higgins at Parliament House in 2019. Today he is asking the court to stay the costs order of $2 million, and fighting a demand from Ten for a security of costs order of $200,000, to allow his appeal to proceed."We are all proceeding on the basis that there'll be no recovery," Ten's lawyer Matthew Collins said.
But he said for the moment there is agreement not to take any steps on the bankruptcy while the appeal is being sorted out.But Mr Lehrmann's lawyer Zali Burrows told the court that hasn't happened, and she believes there was merely an attempted service of papers on Mr Lehrmann's mother.
