Judge made ‘critical error’ in verdict against Obeids and Macdonald, court told | jennynoise
The judge who sent disgraced former Labor MP Eddie Obeid, his son Moses, and former resources minister Ian Macdonald to jail made a “critical error” when she found them guilty of a conspiracy over a rigged tender, lawyers for the trio have told the NSW Supreme Court.
All three are set to appeal, claiming Justice Fullerton erred in making a number of factual findings regarding the Obeids’ involvement. Lawyers for the men also argued there is “no public interest” in keeping them behind bars while they await their appeal – which Justice Wilson indicated could be heard as early as September 2022.Bret Walker AO SC, appearing for Moses Obeid, said his client does not pose a flight risk, but there is a “real risk”, in the absence of bail, that his client may “be detained for up to, perhaps more than, half the period presently stipulated to be served before parole”.
