The leaked legal letters show the vast majority of council officers did not have the state government authorisation required to declare a dog as dangerous or menacing. A council spokesperson said they were not aware if anybody had euthanased their dog because of a declaration. A council spokesperson said they had not told ratepayers that this had happened, since it was no longer necessary."As the 2022 audit of dangerous dogs upheld the original declaration decisions, no correspondence to dog owners was required," the spokesperson said.
The ABC asked the department whether council told it about the breach, what the associated penalties were, and whether any penalties had been enforced.
