The family of a South African boy who fell and drowned in a latrine pit at his school is granted compensation.
It was"the most appalling and undignified death", Justice Eric Leach from the SCA was quoted by local media Mail & Guardian.Local NGO Section27 has been representing the family since 2015. It said it welcomed the result of the appeal.
"The SCA acknowledged that the family's mental agony and grief was exacerbated by the unfeeling attitude of the education authorities," a media release by Section27 said. "This included the treatment by education authorities of the family in the aftermath of Michael's death; the unsympathetic and denigrating cross-examination by the state's advocate; and the state defending what the SCA described as an indefensible case."
The school, in Chebeng village in the South African province of Limpopo, had been asking for extra funding from local government to improve the pit latrines for years, according to local media reports.An estimated 4,500 schools out of a total of 25,000 in South Africa still have pit latrine toilets, according to the BBC.
