The High Court has rejected a claim by anti-abortion advocates that they have a right to protest outside abortion clinics, in a decision that has been welcomed as upholding the validity of NSW's safe access zone laws.

“This definitive statement from the High Court means that the NSW laws drafted by myself and Trevor Khan are valid, and women in NSW are now fully protected by the laws passed by the Parliament last year," Ms Sharpe said. But the most contentious aspect of the law - and the focus of the High Court challenge to Victoria's legislation - was a broad communication offence.

The challenge to Victoria's laws was brought by Kathleen Chubb, an anti-abortion protester who was charged after entering the exclusion zone and attempting to hand a pamphlet to a couple entering a Melbourne clinic in 2016.
