A South Australian MP found guilty of multiple counts of deception has won a bid to postpone his sentencing — and retain his position in parliament — until the outcome of a Supreme Court appeal.

The Liberal-turned-Independent was charged with making more than $18,000 in fraudulent expenses claims in February 2021 following a probe by the Independent Commissioner Against Corruption . "If the member's seat is vacated, which will be declared vacant with a conviction, the by-election is held, a new member is elected," Mr Henchliffe said.

"Your Honour should not, in my submission, change the course of the administration of justice in anticipation of something parliament might do," Mr Walker said. Fraser Ellis is the Independent MP for the state seat of Narungga on South Australia's Yorke Peninsula.Outside court, Ellis said he had "never been worried" about himself and was looking forward to the court proceedings continuing next year.
